How Suspended PTAD DG saved N7billion in 6 months - Group

The suspension of Mrs. Nellie Mayshak, the Director-General of the Pension Transition Arrangement Department (PTAD) has irked members of the Pensioners Rights and Protection Alliance (PPRA) who have labelled the move, “a witch-hunt.”


Speaking in a statement released in Abuja, the Pension advocacy group, represented by the Executive Secretary, Mr. Sule Adams questioned the haste with which the minister of finance, Mrs. Kemi Adeosun suspended the DG without first carrying out a discreet and forensic investigation into the alleged fraud.


“The suspension of Mrs. Nellie Mayshak according to him came to us as a rude shock not because she is above such disciplinary action, but because we find the process leading to it as gravely flawed and undeserving of a Nigerian who had worked hard since the establishment of PTAD to put smiles on the faces of us, Nigerian pensioners.


“It is an open secret that Nigerian pensioners have borne the brunt of the pervasive corruption in the Nigerian society more than any other group after toiling all through their productive years; PTAD and by extension, Mrs. Nellie Mayshak came to reverse the situation after similar interventionist agencies contributed in worsening the situation in the past.” Says the group


They insisted that the allegations are spurious and unfounded based on what they called their knowledge of the workings of PTAD as according to them, all pensioners’ salaries are paid through the Central Bank of Nigeria to beneficiary’s accounts using the Integrated Financial Management Information System (GIFMIS).


They informed also that such payments are tracked through the banks to ensure that every pensioner receives their entitlement immediately they are paid, stressing that it is a known fact that PTAD prepares and submits monthly payroll of pensioners to the office of the Accountant General of the Federation in addition to issuing of payment instruction to the same office which is as adjunct of the federal ministry of finance.


The group therefore wondered why the ministry could now turn around abruptly to deny the agency if there isn’t much to the suspension order than meets the ordinary eye, even as it restate the need for the president to go deeply into the matter.


Mr. Sule Adams informed that PTAD had saved tens of billions of Naira for the nation through the elimination of over 4500 ghost pensioners and of recent saved another N7billion in 5 months that otherwise would have disappeared into the pockets of insurance companies and underwriters.


He said it is equally on record that PTAD has a list of 120 pension fraudsters which it had submitted to the Independent Corrupt Practices Commission (ICPC) for investigations while challenging the public to cross check these assertions from the Federal Ministry of finance and the ICPC respectively.


“It is therefore preposterous to say that the Director General padded the payroll when she has been in the forefront of those fighting against such group.” Mr. Sule Adams argued.


The group which says it cannot sit back and watch pension administration in Nigeria return to the dogs also disproved the widely reported allegations that the Director General was drawing a whopping salary of N60 million every month saying Mrs. Nellie Mayshak earns a little over N3million a month which was duly approved for the office by the National Salaries, Income and Wages Commission and which it says is about the least among its contemporaries in the public financial agencies such as CBN, FIRS ,ICPC ,PENCOM, NSITF, PPRA, to mention but a few.


“How can any civil servant allocate salary to his or herself if it is not an attempt to smear the woman by the endemic cabal of fraudsters whom she had fought relentlessly to remove their hands from the till of hapless pensioners?” the group questioned


Concluding, the pension advocacy group marveled at why Nigerians love to pull down their brightest brains informing that Mrs. Mayshak had a distinguished career that spanned Europe, Asia, Canada and Africa before taking the PTAD job and she came highly recommended.


“Mrs. Nellie Mayshak is not just another Nigerian who was fortunate to get a job because of her gender or who she knows, but because of her track record of performance based a reputation built over the years working with different governments and international agencies in public sector reforms. We therefore call on the minister of Finance and indeed the president to see through the gang up against this intelligent and hard-working Nigerian and not just lift the suspension but clear her name through diligent investigation devoid of bias.” The advocacy group admonished.


Mr. Adams, a retiree from the federal civil service and also an exco member of the Nigerian Union of Pensioners said they the pensioners are now more aware of the management of their pension as regular communication and engagement opportunities are made available to them by PTAD to understand their workings.

Lagos State Government defend huge pension for ex-governors, deputies

The Lagos State Government has justified the enactment of laws prescribing pension for former governors and deputy governors of the state.


The state government insisted that contrary to the contention of the plaintiffs who are challenging the law, through their suit before a Federal High Court in Abuja, the state House of Assembly had the powers to enact such law for former governors and their deputies in the absence of a federal legislation in that regard.


The plaintiffs’ suit, which is before Justice Ahmed Mohammed, was instituted against the 36 states’ governors, their Houses of Assembly, the Attorney-General of the Federation and the Revenue Mobilisation Allocation and Fiscal Commission.


The plaintiffs are 36 non-governmental organisations including Human Development Initiatives, numbering 36, and two activists – Ayodeji Kolawole and Tunde Asaju.


They jointly filed the suit through their counsel, Mr. Chino Obiagwu, on July 15, 2014.


Apart from Lagos State, other state governments such as those of Sokoto, Cross River, Akwa Ibom and Kwara have also defended such laws.


The various states, through their governors and Houses of Assembly, have filed counter-affidavits and notices of preliminary objection seeking the dismissal of the suit.


Justice Mohammed had on Tuesday fixed October 15 for hearing of the applications by some of the state governments.


In their joint counter-affidavit and notice of preliminary objection to the suit, Lagos State governor and the House of Assembly insisted that RMAFC was not the only constitutional body empowered to stipulate the remuneration of public officers.


The counter-affidavit deposed to by a counsel in the office of Lagos State Attorney General, Mr. Justin Jacobs, also stated that the plaintiffs’ suit was misleading, adding that they failed to tender any document to show that the said pension law had been enacted.


But the counter-affidavit did not also deny that the law had been enacted by the Lagos State House of Assembly.


It read in part, “In response to paragraph four of the affidavit in support, I state that the paragraph is not correct to the extent that it states that the 74th defendant (RMAFC) is the only constitutional body mandated to stipulate the remuneration of public office holders in Nigeria, including the 1st – 36th defendants (state governors) and their deputies.”

Lagos State: Life pension for lawmakers against constitutional provisions - Falana

A Lagos lawyer, Mr. Femi Falana (SAN), said the life pension being allegedly proposed for lawmakers in Lagos is against constitutional provisions.

The senior advocate was reacting to a recent media report that members of the Lagos State House of Assembly were deliberating on a bill proposing a life pension for the Speaker of the House and his deputy.


But Falana, in a statement on Sunday, said legislators, being only part-time workers, were not entitled to any form of pension under the Pension Reforms Act, 2014.


He described the move as insensitive and immoral “at a time when workers are owed salaries and allowances.”


He said, “Instead of slashing the salaries and allowances of top public officers, curb waste and eliminate official corruption to meet the cost of governance, legislators are planning to pay pension for life to themselves.


“Last week, the media drew the attention of Nigerians to a bill designed to grant pension for life to the leaders of the Lagos State House of Assembly. If the bill is passed and assented to by the Governor, other Houses of Assembly in the country will surely follow suit. It is therefore pertinent to point out that part-time and temporary workers are not entitled to the payment of pension under the Pension Reforms Act, 2014.”


According to Falana, the position of the law was clear as to the non-entitlement of legislators to pension since they are not civil servants and are only required by the Constitution to sit for not more than 181 days or six months in a year.


He said only the President and governors were entitled to pension in line with Section 84(5) and 124(5) of the Constitution, adding that if the Lagos legislators did not drop the idea, he would not hesitate to challenge them in court

NASS approves life pension for president, vice in new Constitution

ABUJA—THE National Assembly, yesterday, completed the amendment of the 1999 Constitution with approval of life pension for anybody who has held office as President or Vice President, Senate President or Deputy Senate President, Speaker or Deputy Speaker of the House of Representatives.

But beneficiaries of this gesture must be occupants who successfully concluded their terms in office without removal or impeachment.


The amended constitution, which was presented as motion, to  the floor of the Senate by the Chairman, Senate Committee on the Review of the 1999 Constitution, Senator Ike Ekweremadu, for onward transmission to the president for assent, also made it mandatory for the president to appear once a year before the joint sitting of the National Assembly to deliver an address in respect of the state of the nation.


But the president, in the expected constitution, loses the power to solely assent to bills passed by the National Assembly. The same applies to state governors.


The amended Clause read: “Any person who has held office as President or Deputy President of the Senate, Speaker or Deputy Speaker of the House of Representatives,  shall be entitled to pension for life at a rate equivalent to the annual salary of the incumbent President or Deputy President  of the Senate, Speaker or Deputy Speaker of the House of Representatives, provided that such a person was not removed from office by the process of impeachment or for breach of any of the provisions of this Constitution.


“The president shall attend a joint meeting of the National Assembly once a year to deliver an address in respect of the state of the nation. He may attend any joint meeting of the National Assembly, either to deliver an address on national affairs including fiscal measures, or to make such statement on the policy of government as he considers to be of national importance.”
