Jobless politicians cricitize Buhari"s appointment - Keyamo

Lawyer and human rights activist, Festus Keyamo, has described those criticising President Muhammadu Buhari’s appointments as “few jobless politicians.”


Festus KeyamoIn a statement issued on Friday, Keyamo stated that those politicians depended only on government appointments as their means of livelihood.


He said, “The so-called ‘uproar’ over the perceived ‘lopsided’ appointments made so far by President Buhari is nothing but an orchestrated frustration of a few jobless politicians who depend only on government appointments as their means of livelihood and, of course, the noise of the latest opposition party in town.


“The majority of Nigerians want to see good governance, pure and simple, and care less about the ethnic origin of those appointed into positions.


“My worry is that the decade-long general division of government positions into ‘juicy’ and ‘non-juicy’, and the mentality that these few ‘juicy’ positions must be shared equally among the major ethnic groups was nothing but a contraption of the old order from which we have just liberated ourselves.”


Keyamo added that all government appointments posed an equal challenge to those appointed as a call to higher service of the country, saying that all public positions come with an equal responsibility to be honest, forthright and dedicated.


According to him, describing some positions as “juicy” and others as “non-juicy” is another way of identifying positions that have enough money from which to steal from those that are “dry.”


Therefore, any agitation from a section of the country to get “juicy” positions, the rights activist said, was only an agitation for their kinsmen to be appointed to steal enough from which they would benefit.


He said, “I therefore unreservedly condemn, in the strongest of terms, the so-called ‘uproar’ about ‘juicy positions’ going only to a certain section of this country. All sections of this country should be happy and content with whatever positions that the President deems fit, at the end of the day, to give to their kinsmen.


“After all, the President still has a long way to go with appointments. He has not even filled up to five percent of available positions. Please, let the President be.”

Keyamo fails to get SAN rank, Banire, others successful

Lagos lawyer Festus Keyamo again failed in his attempt to get the rank of the Senior Advocate of Nigeria as the Legal Practitioners’ Privileges Committee conferred the rank on 21 lawyers on Friday.


The successful lawyers include, National Legal Adviser of the All Progressives Congress, Dr. Muiz Banire, Dr. Oladapo Olanipekun, who is a son of a former President of the Nigerian Bar Association, Chief Wole Olanipekun, and Emeka Etiaba, a son of a former Deputy Governor of Anambra State, and Mrs. Virgy Etiaba.


Also benefited were Legal Services of the Independent National Electoral Commission, Ibrahim Bawa; Edward Ashiekaa, Benson Nwankwo, Joseph Bamigboye, Patrick Okolo, Prof. Maxwell Gidado, Dr. Tahir Mamman, and Dr. Akinpelu Onigbinde.


Others were Samuel Zibiri, Adeniyi Adegbonmire, Aderibigbe Adedeji, Emmanuel Aguma, Abimbola Akeredolu, Olumuyiwa Akinboro, Gordy Uche, Uchechukwu Obi, Kehinde Eleja and Prof. Paul Idornigie.


Gidado, Mamman‎, and Idornigie were of the academic category while the rest of the 18 lawyers were conferred with the rank as advocates.


‎The only female among the 21 successful lawyers, Akeredolu, was one of the three females in a total of 124 applicants that applied for the rank when the application entry opened in January.


Chief Registrar of the Supreme Court and Secretary to the LPPC, Ahmed Saleh, announced the name of the successful lawyers at a press conference on Friday.


He said the rank was conferred on the 21 lawyers at the 119th general meeting of the LPPC on Friday “as a mark of excellence to the under listed members of the legal profession.”


The 21 lawyers were selected after an interview of the 50 shortlisted candidates held on Tuesday and Wednesday.


Keyamo was shortlisted for the final interview last year but did not make the final list. ‎This made the second time he got so close to getting the rank after previous attempts that failed to earn him an opportunity for the final interview.


Also, a former National Adviser of the Peoples Democratic Party, Chief Olusola Oke, who is now an APC member, was also shortlisted for this year’s final interview but failed to make the final list.


The LPPC secretary, while briefing journalists, said 124 applicants applied for the rank.


Saleh said the 21 lawyers would be sworn in on September 21 at a special court session marking the beginning of the 2015/2016 legal year.


The new SANs will join 408 lawyers both living and dead who had been conferred with the rank since its inception in 1975.

PDP and it’s defectors:  That message from President Jonathan!

The first thought that would have come to many Nigerians on reading the newspaper headlines on Thursday, April 30, must have been to wonder if their president actually said those words or if he was quoted out of context.


“Those people (PDP members) running and those already cross carpeting”, President Goodluck Jonathan was reported to have said, “will come back on an empty stomach because they (APC leaders) will touch the primary members of their party, before they get to you. They know you are coming because you are hungry. Before it will get to you, the food will be gone.”


President Jonathan reportedly made the remarks while receiving the PDP campaign report from the Presidential Campaign Organisation (PCO) at the presidential villa, where he also urged the party and its members to sit tight and put its failures behind and help the party move forward.


Surprisingly, no confirmation or denial has come from the Presidency following the uproar and wide criticisms the statement has elicited.


The implication of the statement is that the president is confirming the popularly held view, which has often come against strong official refutation though, that public office is all about personal enrichment, where everyone goes to acquire material wealth and feed their stomach or goes to “chop”.


Not a few Nigerians will consider the comment a degradation of the exalted office of the President of the Federal Republic of Nigeria. The statement apparently narrows the essence of governance to personal benefits and not its broad definition of the provision of security and welfare, social infrastructure, employment etcetera. As such the president has just told Nigerians that the PDP years in office were primarily to ensure that their stomachs especially those of public office-holders were not empty.


“Come and chop”, first adopted by late Chief Sunday Afolabi, a PDP member and minister of internal affairs during Chief Olusegun Obasanjo’s first tenure, when the late Bola Ige of defunct Alliance for Democracy (AD) (and whom Chief Afolabi was deputy governor to in old Oyo State) was invited and appointed minister of power, to be part of the unity government. The concept of ‘stomach infrastructure’ was later expanded by Governor Ayo Fayose of the PDP last year in Ekiti State, to imply the political philosophy of ensuring everyone gets his share from the booties of public office or so-called national cake. It has abashedly and gradually found a place in the Nigerian literary and political lexicon.


By this utterance, President Jonathan loudly reminds Nigerians that it has been merriment and sharing of common patrimony amongst the few privileged PDP elements in the last 16 years, otherwise, he would be very much encumbered to convince Nigerians on what he meant by “returning on an empty stomachs”.


But this is what makes Nigeria a different clime where almost all manner of absurdities are tolerated. In some saner climes, such statements are very well dissected by the citizens who may force a president to resign.


Miffed by the (un)presidential statement, some Nigerians among whom are human rights lawyer and civil rights activist, Barr. Festus Keyamo spoke to Saturday Vanguard. Others were the National Chairman of the United Progressives Party (UPP) Chief Chekwas Okorie; Member representing Etche/Omuma Federal Constituency in the House of Representatives, Hon. Ogbonna Nwuke; and Hon. Solomon Edojah who has long joined APC.

“My reaction the first day I heard the statement was that I immediately twitted through my twitter handle @fkeyamo that this clearly confirms that the Jonathan government and PDP were all about filling their stomachs.


“That was an extremely careless utterance by the President, but it contains a real suspicion of truth. By his utterances and his hackneyed approach to governance, Jonathan painted a picture of someone not fit to be a Local Government Chairman what more a bigger office. In asmuch as I want to respect the institution of the Presidency, the very person who occupies it is debasing it by his actions and utterances.


“So, to protect the Presidency, we must carefully separate the occupant who is destroying it and let the world see him for who he is.


“My prayer is that may the circumstances that threw up a president who was never ready for that office never befall us again.”


Statement, one of the several blunders of the President – Okorie


“That statement by President Jonathan, to me, is one of the several blunders the man is associated with when he speaks off-the-cuffs. Some times, he is not careful about his comments and he tends to attract too many criticisms.


“There is clear indication by his statement that the essence of joining a party is to go and feed one’s stomach and pocket and therefore those leaving to PDP for APC will come empty handed.


“I thought that the reason to join a party is to render service to whatever constituency whether at the local or national level.


“I think there are many things he could have said to promote the benefit of remaining in PDP rather than retiring to material benefit. It is this materialism that the PDP is associated with and for which it is now on record that corruption has hit an all-time high during his regime.


“So, my advice to him is that if he cannot check his pronouncements, he should insist on a reading one so that some people could assist him there to make articulate views that could stand the test of time.


“Jonathan is not even associated with quotable quotes. This is an aspect of his leadership that is very poor.”


Comment not presidential – Nwuke


“When I first saw the story, I ignored it because in my own opinion, it wasn’t possible that a serving or outgoing president of this great country could make such statement. Nonetheless, I feel that the outburst of the president was not presidential.”


Only food-is-ready people remain in PDP – Edojah


“Why would they come back? Except that the person left on the basis of food-is-ready is a hungry politician who is not desirous of service but desirous of food is ready. All the food is ready people are the ones remaining in the PDP. All the people remaining there are people who don’t want to serve, greedy politicians who cheat their members.


“And I don’t see any reason why anyone who means well for the country should remain in the PDP because the PDP as it is today is already highly impoverished by the leadership. They are already down. They are living a traumatized life.


“So, for somebody to say that if you leave, you will come back hungry, come back to meet what? To meet a set of tiny greedy leadership? So, that was not a fair comment.


“By the way, what is APC? APC is a conglomeration of parties including PDP. If you take away the PDP elements, there is no more APC. You don’t forget, five governors left. In fact they were seven, but the two of them couldn’t get the courage to complete the journey and they retreated for whatever reason. Some for fear of the unknown, others for protection from those in authority.


“PDP deceived most of its members, punished its members, particularly during the primaries, when most of us had what we called phantom primaries. We were duped. Primaries never took place and results were written and we had nowhere to complain to.


“I cannot hold forth for Mr. President because I am not his spokesperson but from hindsight and body language of Mr. President, people know that he, too, is not happy with the shenanigans that took the party.


Bottom line


Obviously, in the reckoning of many Nigerians, the outgoing President (mis)spoke but at the same time revealed what political leadership has actually been in Nigeria. Intrinsically, his statement showed more of what the cabal of the PDP circus has been in the last 16 years.

We have just witnessed a bloodless revolution – Keyamo

Renowned lawyer, social crusader and activist, Mr. Festus Keyamo was one of those who stuck his neck out for General Muhammadu Buhari. Throughout the campaign, he was unrelenting in his vocal support and mobilisation for Buhari.  In this interview, he talked about the victory and his suggestions on the fight against corruption amongst other issues.


Against the barrage of attacks poured on Buhari, how would you describe the victory ?


I think this victory was divinely ordained, because in the history of politics in Nigeria, no politician has been so battered and vilified by the opposite side  as General Muhammadu Buhari was. No ordinary politician could have survived those heavy pounding. But then General Buhari is not an ordinary politician. All over the country he has a cult following amongst the ordinary people, and it is that image that repelled those heavy defamatory artilleries that were directed at him.


His long-acknowledged integrity and incorruptibility saved him from those negative adverts at the end. In fact, for me personally, why I stuck out my neck for him was the incorruptible image of Buhari that my late boss, Chief Gani Fawehinmi created in my mind some twenty-three years ago when I started my practice with him. So it was difficult for that mental image I had of him to be rubbished overnight by some stupid documentaries by some desperate politicians. And that is why for a politician, image is everything and money is nothing. It is also a lesson to some of us that at a much younger age, it is better to develop a legacy of integrity and honesty. These are more enduring possessions than money.


How do you think Buhari can repair Nigeria?


I must confess that the challenges are huge because the damage that has been done by the PDP government at the national level in the last sixteen years has been enormous. There is no doubt that General Buhari has the requisite determination, courage and integrity to deal with the problems. But that is on the one hand. On the other hand, the people he picks to work with him must also key into his own vision and have equal determination and courage to deal with the problems. And yet there is one more angle: The level of the rot left behind by the retreating scavengers of our economy will only be known when Buhari finally has access to the books left behind. It is then we can know just how quickly the repair would take.


What critical sectors of the economy do you think need urgent attention?


The first thing he must develop is a template to address the issue of insecurity.


The economy in many parts of the North has collapsed as a result of insecurity. No economy can grow in the throes of insecurity. Then there is the power sector. Something urgent needs to be done, either by way of fine-tuning what is already on the ground or by a complete overhaul. The free fall of the Naira is also a cause for concern. Something has to be done to halt it immediately.  Issues surrounding the economy must be addressed quickly.


Then there is the problem of unemployment of our teeming youths across the country. And by this, I don’t mean letters of employment should start issuing to everybody immediately! What I mean is certain policies and programmes to revive small and medium scale industries in particular must be urgently developed to empower them to absorb many unemployed persons over a period of time. This is because the private sector is still the key to solving the problem of mass unemployment and not government.


Another problem is the almighty issue of corruption. The public must see a change in the approach of the new government in respect of the fight against corruption. The issue of backlog of pending corruption cases in our courts must be urgently addressed and the issue of cases swept under the carpet because of politics must also be addressed.


Talking about the fight against corruption, the major impediment has been the delay in dealing with corruption cases in court, what is the solution to this?


Well, if you remember, I sent a comprehensive proposal to the National Assembly some few years ago on how to address this problem but it was ignored. I wish they can take a look at it again. This is because the delays in the administration of criminal justice in Nigeria, especially corruption-related cases, have become a notorious fact. Well-meaning Nigerians have consistently raised alarm about this issue.


And it is a well-known fact that justice delayed is justice denied. Justice is denied to the generality of the people of Nigeria when those who are alleged to have committed heinous crimes against the State make nonsense of the law and delay their trials by clever tricks and continue to walk the streets and work their way into public offices to perpetrate more crimes whilst their criminal cases are pending in different courts. At the end of the day, the cases are lost because of the death of witnesses, loss of memory by witnesses, loss of exhibits, loss of interest and zeal by prosecutors and the aggrieved by effluxion of time, the compromise of witnesses by the accused, e.t.c.


In all criminal trials in Nigeria, especially the corruption-related cases, no matter how good the case of the prosecution is, the accused persons, through their lawyers, have now devised a common scheme or strategy to delay the trials and invariably thwart the whole legal process: they simply raise all manner of PRELIMINARY OBJECTIONS to either the Charge, or the proof of evidence, or the appearance of counsel or relating to jurisdiction of the court. They may also wait for the prosecution to lead evidence and then make a no-case submission.


Once they are overruled, (which happens in most cases as most of the Courts find those applications or submissions frivolous) the Accused persons would immediately file interlocutory appeals to higher courts and would always request the lower courts to stay trials pending the appeals. Once the trials are stayed by the lower courts, the appeals take a number of years to get to the Supreme Court before they are referred back to the courts of first instance to begin the proper trial. And take note that there is nothing stopping the defence lawyers from raising another fresh preliminary issue again that they may warrant them going on appeal again and asking for a stay of proceedings again. And this kind of game can go on and on.


Surely, this situation does not augur well for both the accused and the prosecution because even the accused person has a right to have his fate decided as quickly as possible. So the solution is to go back to that document I submitted to the National Assembly some three years ago.


How would you advice the President-Elect against the backdrop of many pitfalls of the Jonathan’s administration?


It is simple: The President-Elect must watch out for those hawks who are now swirling around him and who were never there before. They are called Any-Government-in-Power. These are people without principles, without integrity and without conscience. They will just come in and mess up his government for him. But I trust he has the experience to know how to weed off such people.


He should also not take for granted the present goodwill he has enjoyed across Nigeria. He must never take the people for granted. He must stick to his words and his campaign promises. He cannot solve all the problems overnight but the people must see some genuine efforts on his part and that of his team.


Do you believe in an ‘All-inclusive/Unity’ government as envisaged by the President-Elect?


Look, we are all Nigerians, whether we belong to the APC, PDP or any other political party. So, wherever the President-Elect can find capable hands, he should bring them on board.


When Buhari introduced War Against Indiscipline, WAI, he was a military Head of State. How can he inculcate or bring back discipline in our behavioral attitudes in a democratic setting? Nigeria is about the only country a bus driver stops on the centre of the road to pick passengers, Okada riders drive against traffic and people drop refuse on the streets, things that WAI stopped but are now common with us


The problem has always been enforcement of our laws. If the law enforcement agencies do their jobs, you don’t have to drag the office of the President into this issue. So, the job of the President is to empower, encourage and mandate the law enforcement agencies to enforce the laws of the land, no matter whose ox is gored.


What does this victory portend to Nigeria considering the fact that it is the first time opposition was winning, something many thought would not happen in our lifetime?


For once, the people have used their power to change a Federal Government through the ballot box. It has never happened before. No single shot was fired to achieve this change of government. It is what we call a bloodless revolution. It has lifted our spirits as citizens of this country and it has polished our democracy. The people have now scented blood with power of their PVCs and they will not look back again in using it effectively to change unpopular governments.

Another four years of Jonathan means disaster for Nigeria, says Keyamo

Lagos lawyer, Mr. Festus Keyamo, has said another four years of President Goodluck Jonathan in office would be a great disaster for Nigeria.

Keyamo alleged that corruption has flourished under Jonathan’s watch to the extent that the malaise is affecting the fight against insurgency in the Northeast region with the service chiefs being the beneficiaries of the resources committed to crush Boko Haram.


The human rights lawyer spoke in Ado-Ekiti, the Ekiti State capital, on Saturday at a youth summit organised by the state chapter of the All Progressives Congress (APC) Action Group.


Keyamo said the youths have key roles to play in ending what he called the 16 years of misrule by the Peoples Democratic Party (PDP), warning that a revolution is imminent in the country if the Independent National Electoral Commission (INEC) Chairman, Prof. Attahiru Jega, is removed from office before the end of his tenure.


He deplored a situation in which the Armed Forces of Chad, which is less endowed than the Nigerian Army, is stealing the show in the fight against Boko Haram.


Accusing the service chiefs of feeding fat on the fight against insurgency, Keyamo regretted that Boko Haram, which he described as a ragtag group, has grown in leaps and bounds with Jonathan failing to use his position as the Commander-in-Chief to crush the terrorists.


Keyamo said, “I have an inside knowledge that service chiefs are feeding fat off the situation (Boko Haram) without the knowledge of the president or with his knowledge but he is bereft of what to do.


“How did we get to this point? Under whose leadership has the military been so decimated? It is under the leadership of President Jonathan. Before Jonathan, there had been insurgency, but no part of the country was lost. It was Buhari who crushed the Maitatsine sect. If we give this president another four years, Nigeria will be worse for it.


“This is the time to speak out; we must not be so comfortable in the South and forget what is happening in the north. The economy of the north has been destroyed under the leadership of this incompetent and clueless president. This government announced a ceasefire deal but Boko Haram responded by carrying more deadly attacks.


“The same federal government that has announced the killing of Abubakar Shekau (Boko Haram leader) several times is now saying he must be caught alive. Who did they kill before? It is time to give other people chance to see if they could do things differently.”

Jonathan contracted out the economy to Okonjo-Iweala – Keyamo

Tucked away in the middle of Anthony village in Lagos, is the hallow legal Chambers of renowned activist and radical lawyer, Festus Keyamo. The serenity of the environment betrays the activism in him. The different plagues which adorn the walls of his spacious office are testimonies of his victorious struggles of human rights crusade and series of struggle for the entrenchment of democracy.


Festus KeyamoWhen Saturday Vanguard visited him at his office for this interview, he spoke passionately on the state of the nation. For over forty-five minutes, the lawyer ventilated his views on the postponement of the general election saying all reasons adduced for the shift were balderdash just as he accused President Jonathan for attempting to destroy his own party, PDP. Excerpt.


There was tension before the postponement of the election, even as we speak; there are palpable fears of stalemate, what is your take about the development?


Let me begin by asking a rhetoric question. If it was crystal clear that President Jonathan was coasting to victory from all indices available, despite PVCs and security issues, do you think that the elections would have been postponed? The answer to that question tells the whole story.


The man that is in control of the entire machinery of election is also a candidate. He controls the police, army, customs including those that first flew the kite of postponement are all his appointees. He ignites all of these machinery to seek postponement of the election. He couldn’t have been doing it to favour his opponent. Again, he was not doing it to provide a level playing field for himself and his opponent because the stakes are too high.


The only reason was that he did it to gain an advantage. So, all these talk of PVCs and other things are all balderdash. Why didn’t he reject the so-called victories in 2007 and 2011 elections because in those elections, it was internationally acclaimed by observers that millions of people were disenfranchised. I’m sure you know that the common thing then was that people did not see their names on the register on the day of voting.


In any case, the voter’s registers were not also displayed before the elections. Opposition shouted and shouted, yet, they were not displayed until the day of the election, and you saw strange names on the register. So, the PDP did not know that millions of people have always been disenfranchised and they have been beneficiaries of that. The reasons given for the postponement are nothing but a facade, subterfuge, smokescreen for the real game that is going on behind the scene.


Therefore, the postponement is fueling speculations on a contest that is about to be manipulated. Now, this leads to a sense of frustration, leads to anger. The outburst of the anger may lead to massive protest that may also lead to un-foretold consequences.


So, they should not continue to blackmail people about election violence, that under all circumstances, we condemn. It can’t be under all circumstances, where in broad day light you changed a result you have lost and expect people to be quite. Even without the opposition calling for protest. Violence could be a natural consequence of election manipulation. It happened in Cote de Voire where before the camera, Gbagbo men came to tear the result they were reading to the world and were given another one to read. Under that circumstance, you cannot hold the people down. They should not blackmail the people. Under a circumstance that it is clear that they are losing election and you stop it, you cannot hold the people down. I am not saying anybody is calling for violence, my point is that certain things are natural causes of violence. Everybody should maintain peace.


But security issues, not only PVCs were advanced for the postponement…


All the reasons were balderdash. They started with the PVCs, saying only 65 per cent have been collected. Before the postponement, many states had already declared public holiday to enable people collect their PVCs. At that point also, INEC had said all the PVCs had arrived the country and said the collection would continue up to the eve of election.


So, were they gods to know people were not going to collect their PVCs? So, that argument was outrightly defeated by Jega’s plan. They should have allowed Jega to stool in his own juice at least up to two days to the election and everybody would see that Jega did not make it available. But when they saw that Jega was determined to push on, they came up with the security reason. In previous election, people’s names could not be found in the register and so disenfranchised. So, it was not an aberration that was about to happen. I am not saying it is right, but it was nothing so outrageous to call for a postponement. Secondly, we have always said, that 14 local governments cannot stop 760 local governments ready for election.


For me, it was a non-issue. The numbers of registered voters in those 14 local governments are known already. All that was needed to be done was to get the winner of the Presidential elections from the rest 760 local government councils and add the entire number of registered voters in that area to the losers’ figures assuming that they voted and if the figure is not up to that of the winner, you can declare a winner but if they are more than that of the winner, or that there is an upset, then there is a stalemate. You can now postpone to have supplementary elections in those 14 local government areas. Then you can now deplore the entire machinery of the state to those areas. You could also create a special center for the voters in those areas. Jonathan was only looking for all excuses to favour himself in this election.


 


Apart from the issue of PVCs, Do you really think INEC was fully ready for the election?


If INEC say they were ready, who am I to say no.


When I see people on television making some baseless comments, I cry for my country. You see fraud in their faces. These are people who are not fit to go close to the microphone. Those who say they believe in Jonathan don’t believe in his person, they believe in his pocket. Those who believe in Buhari believe in his person and I am sure you are seeing the fervor around the country. If you look at Fani-Kayode, you will see insincerity on his face. Just about six months ago, he said the direct opposite of what he is saying now, and nothing has changed between six months and now.


Some months ago, on the issue of corruption and Boko Haram, Fani-Kayode was pounding Jonathan and PDP, telling the world that the Buhari and the opposition are the most credible. The volte face of Fani-Kayode is not 20 per cent, or 90 degree, it is 360 degree volte face. He didn’t even turn the steering little by little, he turned it at once calling white what he had called black, and you made that person your Director of Media.


Was government not tinkering with the process to ensure peace?


The New York Times did an editorial on that. It was wholesome. Again, if you read my interview in Washington Post, all these issues were raised. First of all, tinkering with the election process was to halt the momentum of Buhari, it was frightening the way election was coming. Despite the avalanche of adverts by the PDP in the media, the people just remained resolute on change.


Even the polls conducted by Jonathan’s aides, he lost; on-line polls, he lost. Even the one conducted in Jonathan’s catchment areas, he lost as well. Remember, Jonathan has people who have more access and exposed to the internet. You can imagine if they had allowed the election to go on. I asked a question earlier, if he was going to win the election, would he have postponed it? So, they wanted to halt the momentum and see whether they can have some breathing space to change the situation. And now, after the postponement, they kept pounding Buhari with those offensive adverts.


Again, their calculation was that the opposition will run out of funds for campaign and because they have their hands on many resources, they can go any length to continue the campaign against Buhari. I tell you, what the PDP had spent on advert alone can build a whole city that can house 5000 residents. You are in the media and you know what I’m talking about. They have virtually closed down the media with their adverts. Yet, the opposition has the heart of the people. This election is not going to be fought and won by money. It’s all about repairing the obvious damage you have done to the heart of the people. They see blood and human body parts on the road every day, across the country, because of their ineptitude and incompetence.


Again, I look at the adverts, associating Buhari with the 2011 violence, calling him a blood sucker, showing all the damage of the post 2011 election and saying that Buhari called for the violence, showing bodies on the street to arouse our sensibilities and instill fear in us. I ask a very simple question, you are President and Commander-in-chief, completely in charge of security in the country, and I wonder that he has all these evidence since that time, why has no single agency invited Buhari to make a statement? Why did you not make complain to the International Criminal Court, ICC for post election violence, like it happened in Kenya and other parts of Africa?


No single complaint was made by the government? No police officer invited Buhari to make a statement in respect of that. What is the implication of that? You either have a commander in chief who is economical with the truth or who has no time to check those who caused the post election violence. You had the information that somebody destroyed life and property and you are now crying to Nigerians, saying,   ‘see what they have done’ and you are Commander-in-Chief. This is not true and it is most unfortunate.


What is going on is similar to what happened in the time of Abacha as Bola Ige talked about   ‘the five fingers of a leprous hand’. When all the parties then were calling for adoption of Abacha as the only one fit for the job and he kept quite as if he didn’t know what was happening.   Even you as Journalists you must be kidding yourselves if you say Jonathan is completely unaware of what is going on.


With this your submission, do you think Jega has all it takes to conduct free and fair election?


Jega is completely hamstrung. There is no way the INEC chairman can begin to conduct election under this circumstance of security challenges. He cannot start carrying ballot boxes here and there without security. It is a reality that he cannot conduct the election without the support of security agents. It is not possible. The way they are going, they may even force circumstance on him to resign. They will give him a situation that is impracticable for him to go on and that is where Nigerians will come in. My prayer is for it not to degenerate to that level. When most of us were inhaling teargas, fighting for democracy, these individuals were teaching in classrooms. Jonathan was associated with one single protest. He was not in any human rights or civil society group anywhere anytime. So, they don’t know the value of what we have and yet, they are the ultimate beneficiaries of it. I feel bad when I see people abuse icons like Soyinka, even Obasanjo was in jail for this democracy. He was in prison for three and half years and he sweated for it. It was this and other things that created international awareness of what was happening in Nigeria. I want to beg the President that what he is enjoying now, people sweated for it; so, he should not destroy it. If he loses election, he should go honourably. Sycophants around him should also realise that this is about our country and not about Jonathan.


Recently, the Chief Justice of Nigeria warned Judges against being compromised by   politicians, we have heard of similar warning in the past, how is this going to influence fair dispensation of justice?


It is only a matter of hope and prayer because the judiciary has had bags of disappointments and sometime successes. In some cases, the Judiciary restored hope in our democracy and in some cases, they let the people down. It remains the last hope of the common man and for democracy. It is only our prayer because it is a fact that there is corruption in the judiciary. The level of rot may be a subject of debate depending on what level of information you have. The institution that is saddle with the responsibility of checks and balances should be well oiled because human nature is prone to do bad things.   When we go out everyday, some people could wish they could get somethings that are not theirs. It is the consequence of going to get those things illegally that keeps you back. That also applies to the Judiciary. People should also know that the Judges are from this environment and all the issues in the society are also affecting them and   their judgment. So, we must always pray that they don’t allow these variables to becloud their judgment. At times, it may not be financial gratification; at times, family ties and consanguinity could affect judgment because they are members of the society. They have childhood friends, and they cannot be closed to the entire world.


Do you think the EFCC and the other anti-graft agencies have the bite to clampdown on corrupt politicians?


They are hampered by a lot of factors. I have seen a lot of sincerity and hard work in EFCC team. I have worked with them. I have seen patriotism among some of the leaders of these institutions. The problem is that they are hampered by lack of facility to work. They can’t work beyound what is made available. Imagine, one agency trying to police 774 local governments.


But he EFCC had more bite during the Ribadu era!


No! It was the creation of the media. The only thing that happened during Ribadu’s time was that there was an understanding with the courts not to grant bail to those who were charged.


That was all the difference. And because people like Tafa Balogun were not granted bail, Lucky Igbinedion, Alameighsieha entered into plea bargain. Thereafter, some of the second generation governors like Orji Uzor Kalu, Ladoja Timipre Silva, Gbenga Daniel were charged but all of these people as they were entering court they were being granted bail. And that was it. There was the spectacle of the Black Maria. That was the Ribadu style. It was the judiciary that supported that process at that time. But Yar’Adua came with the mantra of rule of law. But they were charged, the crux of the matter was that the intention was not to kick you but to charge you. No single case under Ribadu was tried. All of them could not go to trial.  Probably because of the torture of the prison, they entered plea bargain. None of them went to trial. So, all the hype about Ribadu was a media creation. I am talking as an insider. The only reason was that people were imprisoned and it was like- ‘look, what do you want? Return some of my property and go away.’ In fact most of those Plea Bargains were crazy. They took some of the property from them and they walked away; there was nothing like 10 years imprisonment or anything near it.


Some people will argue that the same method should have been applied


I agree, but the judiciary has to co-operate. Don’t forget that the same media kept saying, you cannot keep people in prison without trial since they are presumed innocent until   found guilty by the court.


This is the problem we are facing in the country, we have a disease but we don’t want to go in for surgery. We have a cancer that requires surgical operation and yet you don’t want to go in for surgery. As Nigerians, what do you want?


The President has consistently said that successive governments did not equip the Military and that was why the fight against insurgents was difficult; again with the fact that this Boko Haram did not start with Jonathan; what should he have done?


This is a very weak argument. We have had so many uprisings, like the Maitasine uprising. The government of the day crushed them and nipped the uprising in the bud. Boko Haram should have been crushed before they became an octopus. Before, they were not occupying territories.  They were only running to their enclaves and hide-outs. The situation is bad now.


Recently, Obasanjo and Jonathan have been at war. Does it not bother you that an elder statesman was so infuriated that he tore his party membership card in the public?


Nigerians should be bothered more about the rot in the ruling party and the state of the nation rather than to worry about Obasanjo’s action. It is an action of an elder


statesman who is deeply troubled. If you remember what I wrote in January, that Jonathan will be remembered as President who destroyed the PDP and almost destroyed Nigeria. Is not worrying that the number one and number two men of the last administration (Obasanjo and Atiku) have been driven out of the ruling party?   Just think deeply about it. How did it come to that point?


Some body who was godfather and leader of a party? Something is wrong. These are people who have shown their open frustration, not just left, but openly driven out of the party. I remember, it got to a point Atiku could not be called to his own ward meeting. The PDP should not use their intrigues and power play to destroy Nigeria as a whole. So, who is to blame if not Jonathan because as the President, he is the leader of the party and the whole nation.


Anywhere in the world, the security of lives and property is number one for any government. But it appears that Jonathan, in the last four years,   had prioritized the privileges of the office rather than the responsibilities of the office.


He and his wife are only interested in being the President and the first lady and neglected the things that come along with them.


Eventually, he auctioned most of his powers out to Okonjo-Iweala. . Okonjo-Iweala just reports to him and he says carry on.   Obasanjo then would listen to every minister and treat every file up till 2am.


Jonathan contracted out the economy to Okonjo-Iweala and contracted the security to the army, and some of the waterways to   some private individuals. It should not be like that.   Without going through scrutiny and every economic detail, every financial transaction, he leaves them in the hands of others. Even politics, at times, the wife hijacked it from him and began to make decisions. I am sure you know what is happening in PDP. I am not the one saying it and you know they have more information than I seem to have. In fact see most of the editorial around the world, the New York Times, The Economist, The Washington Post, all of them came to one conclusion on the two difficult choices Nigeria will make in the elections. Soyinka put it well by saying that one is troubled by his past and the other troubled by his presence. All of them came to a conclusion that let us have a strong hand rather than a weak hand. No amount of advert will change that path.


Again, as the dynamics of the society change, the issues that guide campaign must change. You cannot be campaigning about 1984 issues now. They are missing the point. Human rights are not the issue now.


The issues are Boko Haram, corruption and the economy and you are campaigning about issues that are not current. There is no decree 2, there is no law that says you can detain without trial; when we have a court without outer clauses, chapter four that is fully alive, a National Assembly that is fully alive, a burgeoning private press with internet, facebook, twitter will you now tell me that Buhari will come and shut down all of you? .


The peace accord entered into by both parties recently appeared dead on arrival, why is it not working?


It is cosmetic. First of all, it was not a legal document.


You cannot make people sign an agreement not to commit a crime. It is the law that compels you not to commit a crime. You cannot also say you signed agreement to keep within the bounds of the law. By law, you have to keep within the bounds of the law. It was meant to satisfy international community and after that, our local politics comes lives.

SAN: LPPC drops Keyamo, confers rank on 17 lawyers

THE Legal Practitioners’ Privileges Committee, LPPC, yesterday, said it had awarded the rank of Senior Advocate of Nigeria, SAN, to 17 legal practitioners in the country.

Briefing newsmen in Abuja yesterday, the Chief Registrar of the Supreme Court who doubles as the Secretary of the LPPC, Mr. Sunday Olorundahunsi, said the rank was conferred on the 17 lawyers “as a mark of excellence”.

Olorundahunsi stressed that the committee had at the end of a general meeting it held yesterday, decided to drop five of the lawyers that were initially shortlisted for the rank.


He, however, insisted that the selection was carried out with strict adherence to the provisions of the legal practitioners’ guidelines.


Besides, he disclosed that a total of 109 lawyers across the federation had applied to be elevated to the rank, adding that whereas 23 of them were academicians, he said that three of the applicants were women.


However, he regretted that though two of the law lecturers passed the screening process, none of the female applicants succeeded.


Meantime, among those the LPPC declined to award the rank yesterday included Lagos based lawyer, Mr. Festus Keyamo.


Olorundahunsi further disclosed that the new SANs would be administered oath on September 22, a day the apex court will mark its new legal year.


He gave the names of the new SANs as Dr. Olu Onagoruwa, Prof. Joash Ojo Amupitan, Olusola Olaseni Idowu, Dr. Ernest Maduachi Ojukwu, Ahamefula Ikechukwu Eke Ejelam, Chike George Onyemenam, Tawo Eja Tawo, Olatunde Oluranti Adejuyigbe, Sylvanus Aghumele Ogwemoh.


Others are Dr. Adewale Adedamola Olawoyin, Dr. Joshua Olukayode Olatoke, Teslim Olatunde Busari, Kelvin Chukwudi Nwufo, Dr. Amuda-Kannike Abiodun, Oluwakemi Mufutau Balogun, Hakeem Olatunde Afolabi and Gerald Godwin E. Ezeuko.

Keyamo demands probe into Patience Jonathan’s nephew’s death in Abuja hotel

Human Rights lawyer, Festus Keyamo, has asked the Inspector General of Police to institute a probe into the circumstances surrounding the drowning of Christopher Awin, a nephew to Mrs Patience Jonathan, in the swimming pool of Agura Hotel in Abuja.


In a petition, Keyamo said:  “We are solicitors to Madam Esther Ebiere Gbonkumor and the entire Awin family. They have briefed us as follows: “That on June 7, 2014, their son, Mr Christopher Onoriode Akpomowei Awin, a 31-year old Nigerian citizen, was invited to a picnic by the Ijaw Students’ Association of the University of Abuja as part of the celebration of their cultural week.


“That picnic held at Agura Hotels in Abuja. We were informed that sometime at about 4:00 p.m., the picnic came to an end and all the members of the association left for the University of Abuja campus and their various residences in Gwagwalada, Abuja.


“However, Mr Christopher Awin stayed behind for some swimming exercise.


“In a most bizarre twist of events, Mr Christopher Awin was found drowned to death in the swimming pool of Agura Hotels at about 6:00 p.m later that day and officers of the Garki Division of the Nigerian Police were called in.


“A post mortem has been carried out by a certified consultant pathologist who confirmed that his death was as a result of drowning and further added that if the victim had received help within five minutes of being submerged, he would have survived. Our enquiries have shown that there were two life guards on duty at the pool who curiously left their duty post on flimsy excuses. Further enquiries also revealed that there was a busy bar beside the swimming pool. Inspite of the expected attendant staff presence, the body of the victim was not found until over one hour after he had drowned.”


Keyamo, therefore, urged the Inspector General of police to, as a matter of urgency, constitute a team of investigators to unravel the circumstances surrounding the death.


“We are respectfully inviting you to employ your good offices in ordering a full coroner’s inquest for the purpose of resolving the foregoing queries and charge all those found culpable to court.


“We repose confidence in your good offices and thank you for your anticipated cooperation,” a petition from Keyamo said.

Court scolds Keyamo for absence from Fani-Kayode’s trial

Trial of a former Minister of Aviation, Chief Femi Fani-Kayode, for N100m money laundering charges was stalled on Wednesday at a Federal High Court, Lagos, due to the absence of the prosecuting counsel, Mr. Festus Keyamo.

Justice Rita Ofili-Ajumogobia was dissatisfied with the fact that the prosecuting counsel, who was said to be ill, failed to give the court a prior notification of his absence.


This came as a former President of the Nigerian Bar Association, Chief Wole Olanipekun (SAN), who was in court, told the judge that he had joined the defence and that he would be leading the team as from the next proceedings.


Olanipekun is to take over from Mr. Ifedayo Adedipe (SAN), who will remain a part of the defence team.  Adedipe too was present at the Wednesday’s proceedings.


The judge said that having scheduled the continuation of the trial for Wednesday since March 19, Keyamo ought to have phoned the court to save the time of the court and defence lawyers who came from outside Lagos.


“Lawyers came outside the jurisdiction for the matter,” she said.


A counsel, Mr. Vitalis Ahaotu, from Keyamo’s law firm was in court, but he could not proceed with the matter, the court having ruled earlier that only Keyamo was competent to prosecute the case since he was the one who was given the fiat by the Attorney General of the Federation.


Justice Ofili-Ajumogobia adjourned the matter till May 14 and 15 for continuation of trial.


The judge had on March 19 adjourned the matter till Wednesday and Thursday. But with the latest adjournment, the proceedings scheduled for Thursday (today) had been cancelled.


The EFCC had through, Keyamo, on March 6, 2014, re-arraigned Fani-Kayode on 40 counts of money laundering.


Fani-Kayode, whose arraignment for the same charges was the fourth since they were first instituted against him in 2008, again, pleaded not guilty to all the 40 counts.


The re-arraignment before Justice Ofili-Ajumogobia on Thursday followed the amendment of the previous 47 counts of money laundering involving about N230 million.


The prosecution opened its case on March 10. The trial continued on March 19 and it was subsequently adjourned till Wednesday.


The offences were said to have contravened Section 15(1)(d) and punishable under section 15(2)(b) of the Money Laundering (Prohibition) Act, 2004.
